Can You Resell an Apartment in Ghana Before Completing Payments?
Whether you can resell an apartment in Ghana before full payment depends on three things. Your contract, your ownership position and any required consents decide the route. The main routes are assigning your purchase rights, a formal buyer substitution (novation), or completing the purchase before resale. Eden Heights buyers should confirm the conditions in writing first.
Key points
- A deposit does not always give you a transferable legal interest in the apartment.
- An assignment moves rights. A novation moves obligations too, with every party’s agreement.
- Finding a buyer does not release you from unpaid instalments until a signed release says so.
- What you recover depends on the price the incoming buyer agrees, not on what you have paid.
- Budget for transfer fees, legal costs, taxes and any arrears.
What do you own before you finish paying?
Paying a deposit does not always mean you hold a transferable legal interest in the apartment.
You might hold contractual rights to receive the property once set conditions are met. Or an ownership interest has already passed to you, with payments still owed.
Your lawyer should review the purchase agreement, payment records and ownership documents to confirm your position. Selling a contractual purchase position differs from selling an interest already held in your name. Holding the keys does not settle the question.
What is the difference between assignment and novation?
An assignment transfers a right from one person to another. Section 7 of Ghana’s Contracts Act, 1960 (Act 25) covers assignment of legal rights, subject to the law and to any contrary terms in the transaction creating those rights. Your agreement needs careful review.
Transferring rights does not release you from unpaid instalments by default.
Where an incoming buyer takes over your obligations, your lawyer will likely recommend a novation or another agreement signed by all relevant parties. The documents should state who owes the remaining money and whether you are released from future liability.
Do you need developer consent to resell an apartment in Ghana?
Check your agreement for clauses on assignment, transfer, nomination, resale and developer consent.
The agreement might restrict transfers, require written approval, or set conditions on outstanding payments and the incoming buyer. Get the procedure in writing before you accept money from anyone.
Further consent applies where an existing land interest moves. The Lands Commission, for example, publishes a consent process for assigning or subletting state land. Don’t assume the same process applies to every apartment transaction.
Before you try to resell an apartment in Ghana, read the consent terms twice. For Eden Heights, request confirmation against your signed agreement. This guide does not set out a development-wide resale policy.
How much money do you recover from an early resale?
The amount you have paid is not the amount an incoming buyer will reimburse.
Take this hypothetical example. The figures are illustrative, not Eden Heights prices or terms.
| Item | Amount |
|---|---|
| Original apartment purchase price | GH₵1,500,000 |
| Instalments already paid | GH₵600,000 |
| Balance owed to the developer | GH₵900,000 |
| Incoming buyer’s total agreed commitment | GH₵1,550,000 |
| Amount potentially payable to the outgoing buyer | GH₵650,000 |
If the approved arrangement requires the incoming buyer to pay the GH₵900,000 balance to the developer, GH₵650,000 remains for you before costs.
The result is GH₵50,000 above your payments to date, before fees and tax. This is not a guaranteed profit or a tax calculation. A lower agreed price means recovering less than you paid.
What fees and taxes apply when you transfer an apartment purchase?
Ask for a written breakdown of any contractual transfer or administration fee. Confirm whether the fee is fixed or a percentage, and who pays.
Other possible costs include legal work, brokerage, required consents, stamping, registration and lender settlement charges. Some apply only to certain deal structures.
The Ghana Revenue Authority explains gains from disposing of assets are taxable in some cases, with different treatment for individuals and businesses. Have a tax adviser assess your transaction, including any gain from transferring contractual rights.
Settle arrears, late charges and service charges too. Agree who pays each one before completion.
How should you document the transfer and payments?
An incoming buyer needs the original contract, payments made, remaining balance, specification and completion status.
Ask the developer for an up-to-date statement of account. Disclose any unresolved defects, disputes, variations or payment defaults.
The transfer documents should name who receives each payment, when approval takes effect and which obligations move to the incoming buyer.
Use a lawyer-led completion with safeguards for funds and documents. Get written confirmation of the date your release takes effect. Until then, another person’s promise to pay does not end your responsibility.

What are your options if a transfer is not allowed?
Assignment is one exit route among several.
You might ask for a revised payment schedule, discuss contractual cancellation, or complete the purchase before resale. Each option depends on agreement, affordability and legal requirements.
Cancellation does not guarantee a full refund. Check deductions, notice periods, repayment deadlines and whether any refund depends on a new buyer.
Don’t stop paying without advice. Ask your lawyer about default consequences and remedies.
Contact Eden Heights with your unit details and payment position. Request the available options in writing before you commit to an exit.
Frequently asked questions
Can I sell my apartment in Ghana before paying the full price?
Possibly. Your contract and ownership position decide whether you assign your purchase rights, arrange an approved buyer substitution, or complete before resale. Have your lawyer confirm the route and get any required approvals.
Does finding a replacement buyer release me from instalments?
No, not by default. Your obligations continue until all relevant parties formally agree to release you. The transfer documents should state the release date and who pays remaining instalments, arrears and other liabilities.
Will I get my full deposit back if I cancel?
Your agreement and the law decide this. Refunds sometimes carry deductions, conditions and waiting periods. Ask for a written calculation and repayment timetable before you accept cancellation terms.
Are assignment fees the same across Ghanaian developments?
No. Don’t assume one standard fee. Ask for the written schedule under your agreement. Separate developer charges from legal fees, brokerage, taxes and official charges so you see the full cost of leaving the purchase.
Does Eden Heights allow resale during an instalment plan?
Your purchase agreement decides this. Ask Eden Heights about eligibility, consent, fees, checks on the incoming buyer and release from outstanding obligations. Don’t advertise the unit or accept a buyer’s deposit before you have these answers in writing.
